In addition to the basic finiquito, severance for unjustified dismissal includes: 3 months of salary (constitutional indemnity, Art. 48 LFT) calculated on the Integrated Daily Salary (SDI), plus 20 days of salary per year of service (Art. 50 LFT). You also receive a seniority premium regardless of how many years you worked. For a $15,000 MXN salary with 5 years of seniority, the indemnity can exceed $80,000 MXN.
What is the Integrated Daily Salary (SDI)?
The SDI is your daily salary plus the proportional value of benefits like holiday bonus and vacation premium. It is calculated as: daily salary × integration factor, where factor = 1 + (holiday bonus days/365) + (vacation days × 25% / 365). The SDI is used to calculate unjustified dismissal indemnities. It is always higher than the nominal daily salary.
When does the seniority premium apply?
The seniority premium (Art. 162 LFT) consists of 12 days of salary per year of service, with the salary capped at 2 times the daily UMA. It always applies in unjustified dismissal regardless of seniority. In voluntary resignation or justified dismissal, it only applies if you have 15 or more years of service.
Are taxes deducted from my finiquito?
Yes, the finiquito and severance are subject to ISR (income tax). However, there are partial exemptions: the first 90 days of indemnity are exempt, and the seniority premium is exempt up to a certain amount.
